Booking terms

Draft — not yet legally reviewed. These clauses are a working starting point that reflects how the booking engine actually behaves. Have them checked by a Spanish abogado or your gestor before the site goes live, particularly the cancellation, damage-deposit and consumer-rights sections, which are governed by Spanish consumer law and Decreto 113/2015.

1. Who you are contracting with

Bookings and payments are handled by Konsu Properties S.L.U. (CIF B72416233), owner and holder of the tourist licences. The villas are marketed by Luxe STR Global LLC. Your booking is a direct contract with Konsu Properties S.L.U., and that is the name you will see on your card statement. No booking platform is party to this contract and no platform service fee is charged.

2. Making a booking

A booking is a request until it is confirmed in writing by email. Confirmation normally follows immediately for card and crypto payments, and once cleared funds are received for bank transfers. Prices shown are per stay in EUR and include the cleaning fee unless stated otherwise.

3. Payment

A deposit of 50% of the total is payable at the time of booking, with the balance due 30 days before arrival. Bookings made within 30 days of arrival are payable in full. We accept card payments (processed by Stripe), SEPA bank transfer and cryptocurrency.

Bank transfers must quote the booking reference. Dates are held for 72 hours pending receipt of funds and are released automatically afterwards.

Crypto payments are priced in EUR at the moment the invoice is generated. Where the amount received differs from the invoiced amount because of network fees or price movement, we will contact you to settle the difference.

4. Cancellation and changes

Cancellations more than 60 days before arrival: deposit refunded in full less any non-recoverable payment processing costs. Between 60 and 30 days: deposit retained. Within 30 days: the full booking value is due. We will always try to re-let the dates and refund what we recover.

Date changes are free of charge subject to availability if requested more than 30 days before arrival.

5. Occupancy

The Surf Villa has a maximum occupancy of 17 guests. This limit cannot be exceeded under any circumstances, including infants sleeping in shared rooms. Exceeding it is grounds for immediate termination of the stay without refund.

6. Guest registration

Spanish law requires us to register the identity documents of every guest over 14 with the authorities. You will receive a secure check-in link before arrival. We cannot hand over keys until registration is complete.

7. Damage and security deposit

Where a refundable damage deposit applies it is pre-authorised or collected before arrival and released within 7 days of departure, less the cost of any damage beyond fair wear and tear.

8. Our liability

Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud. Beyond that, our liability is limited to the total value of your booking. We are not liable for events outside our reasonable control, though in such cases we will refund any nights that cannot be provided.

9. Complaints and disputes

Please raise any issue with us during your stay so we can put it right. These terms are governed by Spanish law and any dispute falls to the courts of Santa Cruz de Tenerife.
